Heard Mr. A.M. Barbhuiya, learned counsel for the petitioner.

By this contempt case, the petitioner is alleging non-compliance of the order dated 0808-2022, passed by this Court in WP(C) No. 5003/2022. The operative portion of the order dated 08-08-2022 reads as under:

“4. Accordingly, the matter is remanded back to the District Level Committee, Hailakandi, for reconsideration of the case of the petitioner by taking into

consideration the betterment marks obtained by the petitioner. However, if the DLC is of the considered opinion that the case of the petitioner cannot be considered for the post applied at this stage, the DLC shall take into consideration Clause 15 of the OM dated 01.06.2015, issued by the Department of Personnel(B) and pass appropriate order in accordance with law.

With the above observations and directions, this writ petition is disposed of.”

Perusal of the direction passed by this Court in the order dated 08-08-2022, passed in WP(C) No. 5003/2022, it is seen that no time frame was given to the DLC to consider the case of the petitioner.

Accordingly, this contempt petition is closed directing the DLC to consider the case of the petitioner in terms of the order dated 08-08-2022, passed in WP(C) No. 5003/2022, in its next immediate sitting.
