The instant interlocutory application is filed seeking substitution of the original

respondent no. 5 viz. Bamdev Majumdar who expired during the pendency of the connected interlocutory application – I.A.[Civil] no. 1501/2019, by his legal representatives mentioned as respondent nos. 5[a], 5[b], 5[c], 5[d] & 5[e] who are residents of Golaihati, Kakotyhati, District – Barpeta, Assam.

It is averred that during the pendency of the I.O.[Civil] no. 1501/2019, which is filed for restoration of a writ petition, W.P.[C] no. 5541/2008, the original respondent no. 5 viz. Bamdev Majumdar has expired. As the cause of action survives against the legal representatives of the original respondent no. 5, they are required to be impleaded as legal representatives of the original respondent no. 5.

Mr. Khound, learned counsel appearing for the afore-mentioned respondents has no objection to the said prayer.

Having regard to the averments made to the effect that the cause of action survives against the legal representatives of the original respondent no. 5, the prayer for substitution of the original respondent no. 5 by the following persons :-

“5. On the death of Bamdev Majumdar, his legal heirs

5[a] Smt. Mira Majumdar Wife of Late Bamdev Majumdar 5[b] Smt. Dulumani Majumdar Daughter of Late Bamdev Majumdar 5[c] Smt. Tultul Majumdar Daughter of Late Bamdev Majumdar 5[d] Smt. Sangeeta Majumdar Daughter of Late Bamdev Majumdar 5[e] Sri Nabajyoti Majumdar Son of Late Bamdev Majumdar All are residents of Golaihati, Kakotyhati, District – Barpeta, Assam.”
