By this application under Section 5 of the Limitation Act, 1963, the applicant/appellant has prayed for condonation of delay of 300 days in preferring the connected appeal.

Objection on behalf of the respondent No.1 has already been filed.

We have considered the submissions advanced at bar and have gone through the grounds set out in the application seeking condonation.

The appellant/applicant represents the terminated workmen, whose services were dispensed with way back in the year 2006 by the respondent Management. It is stated in the application that the members of the appellant/ applicant Union are very poor and hand to mouth people and thus, they could not muster the resources to file the appeal in time.

Having considered the submissions of the appellant’s counsel, we are of the view that the delay occasioned in filing the connected writ appeal deserves to be condoned. Hence, the application is allowed and the delay is condoned.

Registry is directed to register the connected appeal and list the same for admission after 2(two) weeks.

Copy of the connected writ appeal be provided to Ms. G. Swami, learned counsel representing the respondent No.1.
