Heard Mr. R.Islam, learned counsel for the applicant. Also heard Mr. S.R.Rabha, learned standing counsel, BTC appears for the respondent Nos. 2, 3 and 4; Mr. S.Haque, learned counsel for the respondent No.4 and Mr. A.Hussain, learned counsel for the opposite party Nos. 8, 9 and 10.
By this application, the applicant is praying for vacation/modification/alteration of the interim order dated 23.03.2022, passed by this Court in WP(C)/1990/2022.
The operative portion of the order dated 23.03.2022 reads as under:
“6. In view of the communication dated 09.08.2021 and the procedure adopted by the Inspector of Schools, Kajalgaon in proposing the name of Abdul Awal Mondol to be the President of the SMDC, we stay the further operation of the communication dated 16.10.2021. All consequential order of the Secretary, BTC approving the name of Abdul Awal Mondol as the President of the SMDC is also stayed until further orders.”

At this stage, Mr. S.R.Rabha, learned standing counsel, BTC has produced the records along with a copy of the order dated 18th January, 2023, issued by the Secretary, Bodoland Territorial Council, Kokrajhar, whereby, the name of the present applicant and one Fakaruddin who were nominated as President and Vice-President were cancelled.
In that view of the matter, I see no reason to proceed with the present Interlocutory Application.
Accordingly, This Interlocutory Application is closed.
