Heard Mr. J. Sarmah, learned counsel for the applicant and Mr. R.R. Gogoi, learned Standing Counsel, Forest Department for all the opposite parties.

The instant interlocutory application is preferred by the applicant for correction of typographical errors which were crept in the order dated 24.02.2023 passed in the writ petition, W.P.[C] no. 7530/2018. The applicant was the writ petitioner in the writ petition, W.P.[C] no. 7530/2018. By the order dated 24.02.2023, the said writ petition was disposed of after hearing the learned counsel for the parties.

In paragraph 3, paragraph 4 & paragraph 5 of the said order, a typographical error of similar nature has crept in as instead of ‘the Assam Minor Mineral Concession Rules, 2013’, the same has been mentioned as ‘the Assam Minor Mineral Concession Rules, 2023’. The learned counsel for the parties have submitted that the said errors are indubitably a typographical error.

This Court is of the considered view that the error had been crept in inadvertently and was merely typographical error. Accordingly, this interlocutory application is allowed.

It is observed that for all intents and purposes, the expression ‘the Assam Minor Mineral Concession Rules, 2023’ appearing in paragraph 3, paragraph 4 and paragraph 5 of the order dated 24.02.2023 passed in the writ petition, W.P. [C] no. 7530/2018, is to be read as ‘the Assam Minor Mineral Concession Rules,

2013’. This order is to be read as part and parcel of the order dated 24.02.2023 passed in the writ petition, W.P.[C] no. 7530/2018.

The applicant is permitted to produce a copy of this order within a period of 1 [one] week from today before the opposite party no. 2 for his consideration for the purpose of reading this order as part and parcel of the order dated 24.02.2023 passed in the writ petition, W.P.[C] no. 7530/2018.
