Heard Mr. B Buragohain, learned counsel for the petitioner. Also heard Mr. RJ Barua, learned Additional Public Prosecutor, Assam.

By this application under Section 439 Cr.PC., the accused-petitioner, namely, Debaranjan Doley, who has been arrested on 15.12.2022, is seeking bail in connection with Bihpuria PS case No. 188/2022 under Section 21(b), 25 & 29 of NDPS Act corresponding to GR case No.

Accused was arrested on 15.12.2022 and since then he has been in custody, but the police has failed to file charge-sheet till date.

Accordingly, the petitioner is entitled for default bail and as such the above named accused shall be released on bail in connection with Bihpuria PS case No. 188/2022 under Section 21(b), 25 & 29 of NDPS Act corresponding to GR case No. 1128/2022 on furnishing bail bond of Rs.25,000/- with one suitable surety of the like amount to the satisfaction of the learned Special Judge, NDPS, Lakhimpur on the following conditions:

(i) The accused should not leave the territorial jurisdiction of the learned Special Judge, NDPS, Lakhimpur without prior permission from the said learned court. The said condition would be scrupulously followed,

(ii) The accused-petitioner shall not hamper with the investigation, or tamper with the evidence of the case,

(iii) The accused-petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Police Officer, and

¶23

(iv) The petitioner shall appear before the Investigating Officer of the above mentioned case as and when called for by the said Investigating Officer.

This application stands disposed of accordingly.
