Heard Ms. K. Malakar, learned counsel appearing for the accused petitioner as well as Mr. B. Sarma, learned Addl. P.P., Assam appearing for the State respondent.

By this petition under Section 439 Cr.P.C., the accused-petitioner, namely, Md. Mridul Ali, has prayed for grant of bail in connection with Diphu P.S. Case No.62/2023 under Section 22(b) of N.D.P.S. Act.

The case relates to recovery and seizure of 147 numbers of insulin syringe, 600 numbers of Buprenorphine Sublingual tablets, 9 numbers of Samplex Plus capsules from the possession of the accused petitioner.

It is noticed that the accused has been in judicial custody since 13.06.2023, that is, for 59 days.

A perusal of the case diary reveals prima facie incriminating material against the accused petitioner and the investigation is yet to be completed.

However, having considered the length of detention in judicial custody (59 days), this Court is of the considered opinion that further continuation of detention of the accused, in the interest of ongoing investigation is not warranted.

Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs. 50,000/- with one surety of like amount to the satisfaction of the learned Special Judge (N.D.P.S. Act), Karbi Anglong, Diphu subject to the following conditions-

i) That the accused/petitioner shall cooperate with the Investigating Officer as and when required;

¶23

ii) That the accused/petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Police Officer or the Court; and

¶24

iii) That the accused/petitioner shall refrain from committing any similar offences in future of which he is accused or suspected of commission.

Breach of any of the above conditions shall render cancellation of bail in accordance with law.
