Heard Mr. M. Sarania, learned counsel for the writ petitioner. Also heard Mr. J.

Chutia, learned standing counsel, KAAC appearing for the respondent Nos. 1 to 5.

The 34 petitioners herein have approached this Court being aggrieved by the move

¶61

on the part of the District Council authorities to evict them from the plot of land which has been allotted to the district judiciary of Karbi Anglong district.

Today when the matter is called up, the learned counsel for both the sides have submitted that the petitioners have already been evicted from the land and the possession of the land in question has also been handed over to the district judiciary. Mr. Chutia, learned standing counsel for the, KAAC has referred to the affidavit dated 07-03-

2022 filed by the respondent No. 4 to submit that out of the 34 families, 20 families have already been rehabilitated by providing alternate land to them after reaching a satisfaction that they were land less people. Mr. Chutia further submits that insofar as the remaining 14 families are concerned, their cases are under verification and if it is found that they are also land less persons, similar benefit will be given to them as well.

Responding to the above, Mr. Sarania submits that if the respondents allocate land to the remaining land less families, then his clients would have no surviving cause of action in the writ petition.

Taking note of the submission of Mr. Chutia that the remaining 14 petitioners’ families will also be allocated alternative land in proportionate manner, if they are found to be land less persons, I disposed of this writ petition by directing that the exercise as proposed by the learned standing counsel be undertaken and completed as expeditiously as possible.

With the above observation, this writ petition stands disposed of.
