Heard Mr. A Boro, learned counsel for the petitioner and Ms. S Sarma, learned Government Advocate, Assam for the respondent No. 1. Also heard Mr. R K Mushahary, learned Standing counsel, BTC for the respondent Nos. 2 to 6.
The respondent authorities in the Irrigation Department have issued a utilization statement, wherein it is specified that the work of “Improvement of Guide bund, RCC lining of Main Canal from ch.1403.50m to 1451451m and branch Canal-2 from ch.985 to ch.1200m of Gargaon FIS (Ph-II) under SCA to TSP” for the year 2016-2017 is under progress.
It is stated by the petitioner that though he has submitted the first running account bill for the said work amounting to Rs.29,21,670/-, but the respondent authorities did not pay him the same. Hence, this writ petition.
Learned counsels for the parties submitted at the bar that this case is covered by the order dated 22.12.2021 passed by this Court in WP(C) No. 7152/2021.
