Heard Mr. P.P. Medhi, learned counsel for the petitioner, who submits that as the petitioner has been allowed to rejoin his post, he does not wish to press this writ petition.

Mr. D. Nath, learned Senior Government Advocate, Assam, appears for the State respondents.

This Court, vide order dated 18.02.2022, had suspended the operation of the suspension order dated 17.02.2022. The suspension order had been issued pending departmental proceeding due to unauthorized absence of the petitioner.

As the petitioner has been allowed to rejoin his post, the respondents should pass necessary order for revocation or cancelling the suspension order of the petitioner dated 17.02.2022. However, the same shall not be a bar for the State respondents to initiate any departmental proceeding against the petitioner, for his alleged unauthorized absence from duty.

Till the State respondents pass necessary order(s) for cancellation/revocation of the suspension order dated 17.02.2022, the interim order dated 18.02.2022, staying the operation of the suspension order dated 17.02.2022, shall continue.

The writ petition is accordingly disposed of.
