In view of the submissions made by the counsels for the parties, the only issue to be decided is with regard to the furnishing of relevant documents to the petitioner, so that he can make a claim for his pension and other pensionary benefits. Accordingly, the petitioner shall approach the respondent no.4 within a period of 2 (two) weeks from today, for receiving relevant documents for making a claim for pension and other pensionary benefits. Thereafter, the petitioner shall submit his claim for pension and the respondents shall make a proposal for payment of pension, which shall be thereafter processed by the respondents for payment of pension and other pensionary dues, if he is eligible for the same. The respondents should however, while considering the prayer of the petitioner for payment of pension and other pensionary benefits, take into account the judgment of this Court in Sanjita Roy & Ors. vs. State of Assam and Others, reported in 2019 (2) GLT 895, wherein this Court has held that for the purpose of payment of pension to regularized muster roll workers, the entire service period of a muster roll worker has to be counted, i.e. the period of service prior to regularization and the period of service subsequent to the regularization order.
