3.1. The construction of the new multi-storied Business Centre [Market Complex] had been completed in the meantime. Some of the persons whose names appeared in the list of 318 vita holders, approached this Court by a writ petition, W.P.[C] no. 6786/2014 with the grievance that they were not allotted the shops in the multi-storied Business Centre [Market Complex]. The said writ petition was disposed by an order dated 07.01.2020 inter alia with a direction to the Deputy Commissioner, Hojai to make an enquiry on the claims of the petitioners therein along with the private respondents therein regarding holding of vitas [shops] under the respondent Municipal Board prior to construction of the multi-storied Business Centre by the respondent Municipal Board. It was directed that while conducting the enquiry, the stakeholders were to be given opportunities to place on record their documents and to make submissions, if any, and after completion of the enquiry, a report be furnished. It was further directed that the process of allotment be done in respect of those persons who are found to be vita holders, based on such report, before construction of the multi-storied Business Centre [Market Complex]. The enquiry was directed to be completed within 45 days.
