Heard Mr. U.K. Nair, learned senior counsel assisted by Mr. M. Dutta, learned counsel for the writ petitioners. I have also heard Mr. D. Nath, learned Senior Government Advocate, Assam, appearing for the State and Mr. M.K. Choudhury, learned senior counsel assisted by Mr. M. Sarma, learned counsel appearing on behalf of the respondent no. 6.

In this writ petition, the tender dated 04/01/2020 floated by the Special Director General of Police (Communication) Assam, for procurement of Video Conferencing equipments, has been assailed by the writ petitioners on the ground that the technical evaluation of the bids were flawed and, therefore, liable to be declared so.

Taking note of the case of the petitioner, this Court had passed interim order dated 07/07/2021 restraining the respondents from finalizing the tender.

When this matter came up for hearing on 18/08/2022, the learned senior Government Advocate, Assam, sought time to obtain updated instruction. Accordingly, the matter was adjourned. Today, when the matter is called up, Mr. Nath has produced a copy of the written instruction dated 22/08/2022, issued by the Special Director General of Police (Communication), Assam, wherein, it has been inter-alia projected that since the impugned NIT was issued on the basis of technology available in the year 2019, which was more than three days back and considering the five years prospective of the Assam Police as well as change of technology, the Department has decided to cancel the tender and float fresh tenders with a view to procure the video conferencing facilities with new technology, which will be at a cheaper price and more user friendly.

If that be so, the challenge made in this writ petition has apparently become infructuous. The learned senior counsel for the rival parties have also agreed to the same.

In view of the above, this writ petition stands disposed of as infructuous.

¶35

The interim order dated 07/07/2021, as extended from time to time, shall stand vacated. Copy of the written instruction dated 22/08/2022 shall form part of the record.
