of Elementary Education, Assam and after a consolidated service of about 34 years claims for a legal right to be promoted as Assistant Planning Officer. In this respect, we take note of another writ petition being WP(C)No.1876/2016 instituted by Samiran Panchanan, who is also working as a Planning Assistant in the Elementary Education Department claims for promotion to the post of Assistant Planning Officer. The said writ petition was given a final consideration by the order dated 23.07.2019 directing the respondent No.1 being the Commissioner and Secretary to the Government of Assam in the Elementary Education Department to undertake an exercise for considering the promotion of Planning Assistant and complete the within three months. It is stated that the said process is yet to be started and the other part of the order having provided that the consideration would be in case of the petitioner therein as well as other eligible candidates. It also meant that the claim of the petitioner was also required to have been considered in the earlier process. It having not been done, a reiterated direction is issued to the respondent No.1 being the Commissioner and Secretary to the Government of Assam in the Elementary Education Department or any other Officer who is presently discharging the duties of Commissioner and Secretary to the Government of Assam in the Elementary Education Department to do the needful within a period of one month to initiate and complete the process of considering promotion from Planning Assistant to Assistant Planning Officer in the Elementary Education Department. The time limit of one month would be strictly followed inasmuch as it has been noticed that the earlier order providing the time frame of three months had not been adhered to by the authorities in the Elementary Education Department and secondly, the present petitioner would soon retire from service. |
