Heard Ms. Ivy Hussain, learned counsel for the petitioner.

The petitioner’s case is that the petitioner’s father died in harness on 29.10.2011, while working as an Accountant in the office of the Joint Director, Animal Husbandry and Veterinary Department, Jorhat. The petitioner prayed for appointment on compassionate ground. The District Level Committee (DLC), Jorhat recommended the petitioner for appointment to a Grade-III post vide Meeting Minutes dated 25.11.2013.

The petitioner’s case is that no further action has been taken by the respondents or the State Level Committee (SLC), with regard to the petitioner’s application for compassionate appointment.

Ms. Ivy Hussain, learned counsel for the petitioner submits that the petitioner’s application should be considered by the SLC in its next meeting.

Mr. T.C. Chutia, learned counsel for the respondents submits that he does not have any objection to the prayer made by the petitioner’s counsel, provided the petitioner’s application has not been considered earlier.

In view of the submissions made by the learned counsels for the parties, the respondents, especially the respondent Nos. 1 & 4 are directed to place the petitioner’s application for compassionate appointment along with the DLC, Jorhat Meeting Minutes dated 25.11.2013 before the SLC for consideration in its next meeting. The same is however subject to the condition that the petitioner’s application has not been considered earlier by the SLC. If it is found that the petitioner’s application has been considered earlier by the SLC, the decision taken by the SLC should be communicated to the petitioner at the earliest.

The writ petition is accordingly disposed of.
