Mr. J. Abbas, learned counsel for the petitioners; Mr. P. Borthakur, learned Additional Public Prosecutor, Assam for the respondent no. 1; and Mr. I.A. Hazarika, learned counsel for the respondent no. 2 are present.
The learned counsel for the parties have submitted that after completion of investigation in relation to Bijni Police Station Case no. 366/2019 [G.R. Case no. 540/2019], the Investigating Officer [I.O.] of the case has already submitted a charge sheet vide Charge Sheet no. 75/2022 dated 07.05.2022 under Section 173[2], CrPC.
In view of submission of the charge sheet during the pendency of the instant criminal petition, Mr. Abbas, learned counsel for the petitioner has submitted that the petitioner would like to seek remedy before the learned jurisdictional trial court.
In view of the above submission made by Mr. Abbas, learned counsel for the petitioner, this criminal petition is closed, reserving the liberty to the petitioner to approach the learned jurisdictional trial court seeking relief as permitted under the law.
