and at the same time, the proprietor of M/s P.D. Associates. There is imputation that the manner in which the accused persons had acted was prejudicial to the interests of M/s Hridi Food and Beverages Limited and the same could be a conflict of interests. The investigation of the case is still in progress and till this stage, the materials that have been collected do not go to prima facie indicate that there is wrongful loss caused to M/s Hridi Food and Beverages Limited in monetary terms due to the alleged commission of act on the part of the accused persons and the same are done prima facie for wrongful gain for M/s P.D. Associates. Though there is possibility of emergence of incriminating materials in the investigation of the case at a later date, considering the fact that both the petitioners have appeared before the Investigating Officer [I.O.] of the case pursuant to the interim protection granted to them on 28.04.2022 which goes to show that they have joined the investigation, this Court is of the considered view that custodial interrogation of the petitioners for the purpose of carrying out further investigation and in the fact and circumstances of the case obtaining as on date, is not necessary and their release on pre-arrest bail, at this stage of investigation, is not likely to cause any prejudicial effect in the further investigation of the case, provided they continue to extend their assistance and co-operation in the further investigation of the case.
