Heard Mr. R. Goswami, the learned counsel appearing on behalf of the applicants in both the interlocutory applications.

IA(C) No.2453/2022 is an application under Section 5 of the Limitation Act, 1963 for condoning the delay of seven days in filing the interlocutory application for substitution of the legal representatives of the sole respondent.

I have perused the grounds mentioned therein and considering the above, this Court is of the opinion that the applicants have been able to show sufficient cause for not preferring the accompanying application for substitution of the legal representatives of the respondent. Accordingly, the delay of seven days is condoned.

The interlocutory application i.e. IA(C) No. 2454/2022 is an application under Order XXII Rule 4 of the Code of Civil Procedure for substitution of the legal representatives of the sole respondent. It has been mentioned in the said application that the sole respondent expired on 25/2/2020 leaving behind the legal representatives as mentioned in paragraph 6 of the said application.

Taking into account that the delay has been condoned and the appellants

have a right to pursue the connected appeal against the legal representative of the original respondent, this Court substitutes the legal representatives of the original respondent, whose names appear in paragraph 6 of the said application as respondent Nos. 1.1, 1.2, 1.3, 1.4 and 1.5 in the accompanying appeal.

The Registry is directed to make necessary corrections in the records on the basis of the instant order. The IAs stands disposed off accordingly.
