Heard Ms. N. Dey, learned counsel for the applicants/petitioners and Ms. S. Sarma, learned Government Advocate, Assam for the opposite party/respondent Nos. 1 to 5. Also heard Mr. A. Ahmed, learned counsel for the opposite party/respondent Nos. 6 to 15.

By this Interlocutory Application filed on 18.05.2022, the applicants/petitioners have prayed for impleadment of one Sri Chandra Saikia, son of late Powel Saikia, Village-Barkachari Gaon, P.OBorhola, P.S.-Ghiladhari, District-Golaghat as party respondent No. 16 in the connected WP(C) No. 2358/2022 stating that he is one of the members of 10 members Ad-hoc Committee constituted by the Assistant Commissioner, Golaghat relating to Sri Sri Athkhelia Namghar which is challenged in the connected WP(C) No. 2358/2022, presently pending for adjudication.

To that extent, Ms. Dey, learned counsel for the applicants/petitioners has placed before the Court the Annexure 3 to said WP(C) No. 2358/2022 relating to the order dated 10.02.2022 issued by the Assistant Commissioner, Golaghat constituting the said 10 members Ad-hoc Committee that includes the name of said Chandra Saikia.

It is submitted that the name of Sri Chandra Saikia has been inadvertently dropped in the connected WP(C) No. 2358/2022.

Considering the above, the Court is of the view that Sri Chandra Saikia is a necessary party for proper adjudication of the connected WP(C) No. 2358/2022 and as such, the applicants/petitioners are directed to implead said Sri Chandra Saikia as party respondent No. 16 in the connected WP(C) No. 2358/2022.

Accordingly, this Interlocutory Application stands allowed.
