This is an application under Section 439 Cr.P.C. praying for bail of the accused applicants, namely, 1. Abdul Mazid @ Abdul Majid @ Abdul Mojit & 2. Azmal Shad @ Azmal Hussain , who are in detention in connection with Dhing PS case No.104/2022 under Sections 147/341/325 /326/307 IPC .

The applicants are in custody since 02.06.2022 respectively.

Having considered the allegations made in the FIR and also the length of detention in custody, this Court is of the view that further custodial detention of the applicants is not necessary for the purpose of investigation. Accordingly, the applicants above named be allowed to be enlarged on bail of Rs.10,000/- each, with a suitable surety of the like amount to the satisfaction of the learned CJM, Nagaon. The above bail application shall be subject to following conditions:

The accused applicants shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts either to the Court or to any police officer.

The applicants shall not leave the territorial jurisdiction of learned CJM, Nagaon without his prior permission.

¶20

The applicants shall not hamper with the investigation of the case and tamper with the evidence.

¶21

The accused applicant shall not go within the vicinity of 500 meters of the victim or her family members and shall not under any circumstances threaten the victim or her family members.
