Heard Mr. J Laskar, learned counsel for the applicant and Mr. R.J. Baruah, learned Addl. PP, Assam.

This is an application under Section 439 Cr.P.C. praying for

bail of the accused applicants, namely, 1. Rakib Uddin Mazumder & 2. Shakilur Rahman Mazarbhuiya , who are in detention in connection with Algapur PS case No.55/2022 under Sections 120(B)/365/368/379/34 IPC .

Although case diary was called for but it has not been received yet.

The applicants are in custody since 27.05.2022 respectively.

Having considered the allegations made in the FIR and also the length of detention in custody, this Court is of the view that further detention of the applicants is not necessary for the purpose of investigation. Accordingly, the applicants above named be allowed to be enlarged on bail of Rs.25,000/- each, with a suitable surety of the like amount to the satisfaction of the learned CJM, Hailakandi. The above bail application shall be subject to following conditions:

The accused applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts either to the Court or to any police officer.

The applicants shall not leave the territorial jurisdiction of learned CJM, Hailakandi without his prior permission.

¶24

The applicants shall not hamper with the investigation of the case and tamper with the evidence. The bail application stands disposed of.
