Apprehending arrest in connection with Abhayapuri PS Case No. 921/2021, registered under Sections 420/379 of the Indian Penal Code, 1860, this application under Section 438 Cr.P.C. is preferred by applicant/petitioners, 1) Lutfor Ali Bhuyan @ Lutfor Bhuyan and 2) Nur Alom Bhuyan @ Alam Ali Bhuyan, for grant of pre-arrest bail.

The aforesaid case has been registered on the basis of one FIR lodged by one Rohiton Nessa on 02.10.2021.

Mr K K Parashar, learned Additional Public Prosecutor submits that after completion of investigation, the IO has submitted charge sheet vide Charge Sheet No. 78/2022, dated 28.02.2022.

Since the Charge sheet has been submitted, there is no question of hampering of investigation. Now, the trial will start and the accused has to prepare his defence.

In view of above, the bail application stands disposed of with a direction to the petitioners to appear before the learned SDJM, Abhayapuri, within 15 days from today and to file a petition for regular bail and in the event of filing such application, the learned Court shall dispose of such application in accordance with law.
