Heard Mr. A. Ikbal, learned counsel for the applicant and also heard Mr. K. K. Das, learned Addl. Public Prosecutor for the State respondent.

Apprehending arrest in connection with Baihata Chariali PS Case No. 135/2022 under Sections 420/406 IPC, this application under Section 438 of the Code of Criminal Procedure, 1973, is preferred by accused/applicant, namely, Syed Mudassir Ramiz , for grant of pre-arrest bail.

The aforesaid case has been registered on the basis of an FIR lodged by one Arjuwara Begum on 14.04.2022.

Mr. K. K. Das, learned Addl. PP, Assam submits that the IO has completed the investigation and charge-sheet, being Charge-sheet No. 117/2022 dated 04.07.2022.

Since the Charge-Sheet has already been submitted, after completion of investigation, there is no question of hampering investigation or tampering the witnesses. Now, trial will start and the accused has to prepare his defence.

In view of above, this anticipatory application stands disposed of by directing the applicant to appear before the learned CJM, Kamrup within a period of 15 (fifteen) days from today and to file a petition for regular bail and in event of filing such petition, the learned Court below shall consider the same in accordance with law.

Till then, interim protection extended to the applicants, vide order dated 13.05.2022, shall continue.

In terms of above, this anticipatory bail application stands disposed of.
