Heard Mr. D.K. Jain, learned counsel for the petitioner. Also heard Ms. S. Chutia, learned Standing Counsel, Water Resources Department.

The petitioner was allotted the work orders vide work order nos. G-10/DD/08-09/194 dated 16.05.2008, G-10/DD-07-08/152 dated 20.02.2008, G-10/E/07-08/106 dated 28.12.2007, G-10/E/07-08/115 dated 28.12.2007, G-10/Bamungaon/08-09/10 dated 11.04.2008, G-10/DD/07-08/150 dated 20.02.2008, G-10/DD/07-08/143 dated 20.02.2008 and work order no. G-10/E/08-09/163 dated 23.05.2008. As against the said works, the petitioner is entitled to an amount of Rs. 3,85,831/- as per the statement showing the outstanding liabilities certified by the Executive Engineer, Dibrugarh W.R. Division, Dibrugarh.

Ms. Chutia had received the instruction and submits that the liability mentioned in the outstanding statement of the Executive Engineer is an admitted part.

In view of the same, this writ petition stands disposed of with a direction to the respondent no. 5 to disburse the said admitted liability to the petitioner as per the guidelines of this Court stated in Tamsher Ali and Ors. vs. State of Assam and Ors., reported in 2008 (4) GLT 1.
