In this writ petition, the petitioner has made a prayer for cancellation/rejection of the tender notice dated 09.02.2021 issued by the Executive Officer, Sarupathar Municipal Board for settlement of Sarupathar Parking Place, Sarupathar Daily and Weekly Market amongst other markets. The ground in making such prayer is because of the fact that the present petitioner is the sitting lessee of the said Sarupathar Parking Place which was settled on 07.03.2020. But due to the situation arising out of Covid-19, he could not operate the said parking place for a substantial period out of the total 1 (one) year lease period. As such, representation was also made for extension of the lease period of the said parking place in terms of the notification no. P.D.A. 403/2018-30 dated 29.05.2020. The said notification dated 29.05.2020 referred by the learned counsel for the petitioner was under compelling circumstances in as much as the settlement period of the various markets under various Panchayats were due to be completed on 30.06.2020 and as there was no scope for going ahead with fresh settlement process by way of tender, as such, the said notification was introduced in order to continue with the settlement with an intent to earn revenue by Government. Accordingly, the situation prevailing at that relevant point of time and the one prevailing now i.e. when the NIT was issued by the Executive Officer, Sarupathar Municipal Board cannot be equated.
