The petitioner was elected as Gaon Panchayat President of No. 70 Dharmapur Bhatnapatiti Gaon Panchayat of No. 1 Mandiya Anchalik Panchayat. By order dated 23.03.2021, passed in Misc. (Election) Case No. 12/2019, the learned District Judge, Barpeta set aside and quashed the election of the petitioner as President of the said Gaon Panchayat. The Election petition was disposed of after conducting recounting on the basis of which the respondent No. 3 was found to be elected by margin of 1 Vote. Consequent to the same, the Deputy Commissioner, Barpeta on 25.03.2021 passed an order in favour of the respondent No. 3. Those orders dated 23.03.2021 passed by the District Judge, Barpeta in Misc. (Election) Case No. 12/2019 and the consequential order passed by the Deputy Commissioner, Barpeta on 25.03.2021 were set aside by order dated 13.08.2021 in WP(C) No. 2437/2021 that was preferred by the petitioner remanding the matter back to the learned District Judge, Barpeta to decide the said Misc. (Election) Case No. 12/2019 after framing proper issue/issues, allowing the parties to adduce necessary evidence required in order to dispose of the said Election petition as per the relevant law; directing both the petitioner and the respondent No. 3 to appear before the said Court of learned District Judge, Barpeta on 04.09.2021 observing that an endeavour shall be made to dispose of the Election petition within a period of 4 months from the first date of appearance of the parties considering that the matter involves the election process/election result.
