Mr. S. R. Gogoi, learned counsel for the petitioner submits that pursuant to order dated 29.7.2021 passed by this court the petitioner has been allowed to join as LDA cum Typist in the office of the Prison Welfare Officer, Jorhat against that offices earlier order vide No. DSW (ICDS) E- 105-05-8 dated 16.11.2005. Therefore the order dated 28.2.2013 passed in WP(C) No. 3951/2010 has partially been complied.
The counsel for the petitioner submits that the said order dated 28.2.2013 passed in WP(C) No. 3951/2010 also provided that “after regularisation of the service of the petitioner both at Pakabetbari, Jorhat he shall be paid his salary both current and arrear.” But till date neither the arrear salary nor current salary was paid.
Learned counsel for the respondent Mr. J. K.Goswami, learned Addl. Senior Govt. Advocate submits on instruction that payment of salary is under process and arrear salary can be paid within a period of three months.
Accordingly this writ petition is disposed of with a direction to the respondent authorities to pay the arrear salaries to the petitioner within a period of three months from today. So far relating to current salary, that shall be paid to the petitioner forthwith and when becomes due.
With the aforesaid observation this writ petition is disposed of.
No order as to cost.
