Learned counsel for the applicants, Mr. M.J. Qadir and learned counsel for the respondent Nos. 1 (a), 2 to 18 & 59, Ms. U. Baruah are in attendance.

By this interlocutory application under Section 5 of the Limitation Act, 1963, the applicants have prayed for condoning the delay of 4 (four) days in filing the application for substitution of the legal heirs of respondent No. 35, Ataur Rahman Barbhuiya, who died on 18-10-2018.

¶23

Having considered the cause shown in the petition, the four days delay seems to have been satisfactorily explained. Accordingly, the delay is condoned and this interlocutory application stands allowed and disposed of.
