It is stated by Mr. J. Roy, learned counsel for the applicant that the subject matter at dispute

pertains to certain tender process. Upon interference with the earlier tender process, a fresh tender process was initiated in the meantime and the appellant has also participated in the same.

In view of such circumstance, the appellant is not interested to pursue with the appeal in Serial No. 11986/2019. The Writ Appeal was not numbered as because there was also an interlocutory application for condoning the delay of 166 days. As the writ appeal itself is not further carried forward by the appellant, submission is made that there is no requirement to take up the interlocutory application.

In view of such submission, the interlocutory application as well as the writ appeal bearing Serial No. 11986/2019 stands closed.

As prayed for, liberty is granted to approach the Court again, if advised.
