By this application under Section 5 of the Limitation Act, the petitioner has prayed for condoning the delay of one day in preferring the second appeal against the judgment and decree dated 06.09.2017 passed by the learned Civil Judge, Karimganj in Title Appeal No. 8/2017.

Learned counsel for the respondent No.1 submits that she has no objection in condoning the delay of one day.

Having heard the learned counsel for the petitioner and also the reasons assigned for the delay in the petition, I am of the view that the petition for condonation of one delay is deserves to be allowed. Accordingly, the petition is allowed. The delay of one day in preferring the second appeal is condoned.
