It is submitted that the petitioner No. 1 died on 3.12.2018 leaving behind the following

1(b) Sri Jayanta Roy, aged about 45 years

1(c) Smti.Ruma Roy, aged about 42 years

All are the residents of Gach Kali Bari Road, P. O. And Dist Karimganj, Assam, PIN 788710”

During the pendency of this revision petitionthis application for substitution is filed on 27.2.2019 which is well within the prescribed period of 90 days before abatement. Mr Mukherjee raised no objection.

Accordingly, this petition is allowed thereby substituting the legal heirs of petitioner No.

¶44

1 as right to sue still survives against the present respondents.
