Heard Mr. SS Roy, learned counsel for the petitioners who has filed an application for striking out the names who are impleaded as respondents Nos. 2 and 3 in the connected Writ Petition © No. 4306/2017.

It is submitted that vide letter dated 6.9.2017 (Annexure- 1 of this petition) as per the instruction of the HQ Deputy General Border Roads 765 BRTF moved to Uttaranchal after handing over the land under their possession under Mouza- Silchar Town Part-V of Barakper GP had already been handed over to the Deputy Commissioner, Cachar, Silchar on 16.10.2017. Under such circumstances, the petitioners are not necessary parties in the writ petition.

Ms. M. Medhi learned counsel appearing on behalf of the opposite parties submits that she has no objection in striking out the names of the said respondent Nos. 2 and 3 in the writ petition.

Accordingly, considering the submission of the learned counsel, this petition is allowed and disposed of.
