As stated supra,^{the Defendantsremained ex-parteThe} Evidence Affidavit^{coupled with the recitals in the documents} viz., Exs. A.1^{to A.23 marked on behalf of the ApplicantBank} clinches the^{claim of the ApplicantBank against the Defendants'} Hence, I hold that^{the Defendantsare jointly and severallyliable} to^pay the^{TA claim to the Applicant-Bankwith future interest} and costs.

In the result, the present Transfer Application No.05/2026 allowed as under: _

i) fne Defendants are joinfly and severally liable to pay to the Applicant Bank a total sum of Rs.2,82,97,584/_ i.e., a sum of Rs.L,94,7g,B7B/_ towards Cash Credit Facility, a sum of Rs.50,40,314/_ towards Term Loan and a sum of Rs.37,72,3g7/_ towards Term Loan; with future interest @9.30o/o p.a. simple from the date of application till the date of realization;

ii) the TA claim is secured by way of mortgage of properties described in the schedule annexed to the TA and the applicant bank is entiued to proceed against the same to realise its debt;

iii) the applicant bank is also entiUed to proceed against the person and properties of defendants for realization of its dues;

iv) the applicant bank is entitled for the costs.

B. The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.

Issue Recovery Certificate accordingly.
