The Applicant Bank filed the present OA for the recovery a total sum of Rs. 1,00,12,851.86 ps as on 31.10.2025 from defendants 1 & 2 jointly and severally with future interest @ 7.95o/o p.a. with monthly rests from the date of application till the date of realization along wlth costs, and in default sale of OA mortgaged property.

Summonses served on Defendants 1 & 2 through paper publication and were set exparte on 25.06.2026 as called absent and no representation.

The Applicant Bank examined Mr. Ashish Tiwari, Chief Manager, as AW-1 and marked 11 documents through them as Ex.A.1to ExA.11. 1ffi*

As stated supra, the^{Defendantsremained ex-parte' The} EvidenceAffidavitcoupledWiththerecitalsinthedocuments viz., Exs.A.1 to A.11^{marked on behalf of the ApplicantBank} clinches the claim^{of the Applicant Bank against the Defendants'} Hence, I hold that the^{Defendantsare liable to pay the OA claim} to the Applicant^{Bank with futureinterest and costs'}

In the result, the^{present Original ApplicationNo'83/2026is} allowed as under:^-

i) The Defendants 1 & 2^{are jointlY and} severally liable to^{pay to the ApplicantBank a} sum Rs. 1,00,12,851.86 PS^{with future} interest @ 7.95o/o^{p.a. simple from the date} of application till^{the date of realization;}
