Ms. Parveen (Applicant) has filed this Securitization Application under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act), against the Bank of Baroda (Respondent).

She had requested the Bank to conduct a proper inquiry, but no inquiry was conducted. As per the account statement, even her minor son has withdrawn money, which is not possible. She was not served with any notice under Sections 13(2) and 13(4). On these facts, she filed the present SA, stating that the SARFAESI action be set aside as she was not served with any notice. Further, no possession notice was served upon her. Bank has also not pasted the auction notice. There is no CERSAI registration. Accordingly, it is stated that the entire SARFAESI action be set aside.
