Hem Raj (Applicant) has filed this Securitization Application under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act), against the Jogindra Central Co-operative Bank Limited and another (Respondents).

No notice under Section 13(2) was served upon him. On these facts, the Applicant filed the present SA to set aside the possession notice and quash the SARFAESI action.
SA. The Applicant has played fraud with the Bank. The Applicant had raised a loan by creating security interest in respect of some land,

whereas he constructed a house on some other land. There is no merit in the SA, and the same is hereby dismissed . All the pending IAs, if any, are also stand disposed of accordingly.
