In this matter, the counsel for the respondent bank submits that the property has been mortgaged in the year 2018. The applicant herein contents that they have purchased this property on 06.10.2023 from Shanti Devi Maheswari who purchased from Sh. Anjani Kumar Sharma on 08.07.2016. The property on which claim is lodged by the applicant is Flat No. G-1, on the plot no. B-24 (East Part), Roop Vihar, Swej Farm, Jaipur . The property is admittedly not in the ownership of the borrower.
Having heard the arguments and looking into the facts of the case, no reply is required as on date. The alleged mortgaged is with the bank and the property was already sold and not in the name of the mortgagor so no reply is required.
