Punjab Gramin Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.24,00,313.53p with interest against Sh. Nirvail Singh @ Nirvel Singh and another (defendants).

Bank’s case is that on 30.06.2014, it had granted K.C.C. Limit of Rs.13,23,280/- to defendants for agricultural purpose. To secure the loan, Defendants had mortgaged their land (fully detailed in para No.3A of the application). On 06.02.2015, at the request of defendant No.1, bank had granted him a loan of Rs.1.00 Lacs under Debt Swap Scheme for Personal purpose. Both the loans were chargeable at different rates of

interest. Defendants had duly acknowledged their liability towards the debt on 30.08.2016, 12.10.2017, 20.10.2017, 22.10.2019, 26.05.2021, 27.02.2024. On 25.05.2024, a sum of Rs.24,00,313.53p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 22.07.2024, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 04.08.2025, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Hemant Aggarwal, Branch Manager along with the loan and security documents and marked them as Exhibit A-1 to A-14. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of Rs.14,23,280/- and on 25.05.2024, a sum of Rs.24,00,313.53p was due. 6. Accordingly, the application of the bank for the recovery of Rs.24,00,313.53p (Rupees Twenty Four Lacs Three Hundred Thirteen and Paise Fifty Three Only) i.e. Rs.23,73,085.53p in K.C.C. Limit with interest @10.35% p.a. and Rs.27,228/- with interest @10.50% p.a. (both facilities) with half-yearly rests from 27.05.2024, till the date of payment is hereby allowed with costs. The liability of defendant No.2 would be to the extent of amount due in the C.C. Limit whereas liability of defendant No.1 would be for the whole decretal amount. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendants accordingly.

Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 05.03.2026, who is directed to distribute the sale proceeds of the mortgaged land and standing crops as per the provisions of Section 19(20-AB) of the Act . 10.
