Indian Bank (Bank) has filed this application under Section 19 of

the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.37,77,226/- with interest against Sh. Amarjit Singh (since deceased through legal heirs).

Bank’s case is that on 13.11.2015, it had granted a loan of Rs.30.00Lacs to deceased defendant in the form of C.C Limit for agricultural purpose. To secure the loan, Defendant had mortgaged his land (fully detailed in para No . 3A of the application). On 29.03.2018,

bank restructured the loan and converted it into a Term loan of Rs.3,67,431/- at the request of Defendant no.1(d). The loans were chargeable to different rates of interest. On 29.03.2023, a sum of Rs.37,77,226/- was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 10.06.2024, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 24.01.2025, he proceeded was ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mr. Jaswinder Singh, Authorised Officer along with the loan and security documents and marked them as Exhibit A-1 to A-21.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced loans under different schemes and on 29.03.2024, a sum of Rs.37,77,226/-was due.

Accordingly, the application of the bank for the recovery of Rs.37,77,226/- (Rupees Thirty Seven Lacs Seventy Seven Thousand Two Hundred and Twenty Six Only) with interest @8.55% per annum with half-yearly rests from 27.05.2024, till the date of payment is hereby allowed with costs. The liability of the legal heirs of the deceased defendant would be limited to the extent of property inherited by them from Amarjit Singh. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application.
