Summons served on sole defendant through paper publication and was set ex-parte on 05.05.2026 as called absent and no representation.

The Applicant Bank examined Mr. K. Arun Raj, Chief N4anager, as AW-1 and marked 21 documents through him as Ex.A.l to Ex.A.21.

Heard the learned counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is enti ed for the claim made in the OA against the Defendant and OA hypothecated vehicle?

As stated supra, the Defendant remained ex_parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs.A.1 to A.21 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendant. Hence, I hold that the Defendant is liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.81/2026 is allowed as under: -

i) The Defendant is tiabte to pay to the Applicant Bank a sum of a total sum of Rs.86,23,110.05ps i.e., a sum of Rs.70,63,081.39 towards Term Loan_ 1, a

sum of Rs.4,78,357.66ps towards Term Loan-II and a sum of Rs.10,81,671.00ps towards Cash Credit with future interest @10.600/o^{simple fromthe dateof application} till the date of realization;

ii) the OA claim is secured by way of hypothecation of vehicle described in the schedule annexed to the OA and the applicant bank is entitled to^proceed against the same to realise its debU

iii) the applicant bank is also entitled to^proceed against the^person and vehicle of defendant for realization of its dues;

iv) the applicant bank is entitled for the costs.

The Applicant Bank is directed to file Cost !1emo within 2 weeks from the date of receipt of this Order-
