The Appticant Bank^{filed the present OA for the recovery a total} sum of Rs. 60,56,721/-^{with future interest} @12.70olo^{p a. from} 10.06.2025 till the date of^{realization alongwith costs and,in} default, sale of OA mortgage^property.

Summon served on defendants through^{paper publicationand} were set exparte on 75.72.2025 as called absent and^no representation.

The Applicant Bank examined Mr. P.V.S. Srinivas,^lvlanaqer, as AW- 1 and marked 18 documents through him as^Ex.A.1 to Ex.A.18.

Heard ex-parte arguments from the Ld. Counsel of^the Applicant Bank. Perused the material^{placed on record.}

The point that arises for consideration^is:

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendant and OA mortgage prope rty ?

As stated supra, the Defendants remained ex-parte.^The Evidence Affidavit coupled with the recitals in the^documents viz., Exs.A.1 to A.18 marked on behalf of the^{ApplicantBank} clinches the claim of the^{Appllcant Bank against the Defendants.} 0w*'

Hence, I hold that the^{Defendantsare liable to pay the OA claim} to the Applicant Bank^{with futureinterest and costs'}

In the result, the^{present Original Application No'603/2025is} allowed as under:^-

i) The Defendants are liable to^{pay to the} Applicant Bank a sum^{Rs. 60,56,121l- with} future interest @6.25olo^{p.a. simple from the} date of application till^{the date of realization;}

ii) the OA claim is secured^{by way of mortgage} of property as described^{in the schedule} annexed to the OA and^{the applicant bankis} entitled to^proceed against^{the same to} realise its debt;

iii) the applicant^{bankis also entitled to proceed} against the^person and^{properties of} defendant for^{realization of its dues;}

iv) the applicant^{bank is entitledfor the costs'}

B. The Applicant Bank^{is directed to file Cost Memo within2 weeks} from the date of^{receipt of this Order.}
