The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.32,91.,672l- (Rupees Thirty Two Lakhs Ninety One Thousand Six Hundred and Seventy Two only) i.e.,

a) A sum of Rs.22,41,505/- under loan A/c. No.41906849927 with further interest @ L4o/o p.a with monthly rests from date of filing of OA till the date of realization ;

b) A sum of Rs.10,50,167/- under loan A/c. No.42560407298 with further interest @ 13.15% p.a with monthly rests from date of filing of OA till the date of realization ;

As per the averments in the application, the Applicant Bank states that defendant 1 Mrs. Aleti Aruna availed personal loan of Rs.9,44,000/under Xpress Credit on 28.I2.2023 and agreed to repay the loan in 72 EMIs at Rs.18,041/- with interest @ 11.15olo p.a with monthly rests, After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 08.01.2025 and issued legal notice dated 04.11.2025. 4, Sri Ajit Singh Yadav, Managerof theApplicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.14.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the oA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.Al to A.14, In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant No.1 and hence the Applicant Bank is entitled to recover the claim made in the oA with future interest and costs.

In the result, the present OA is allowed with costs, as under: The Defendant No.1 is liable to pay to the Applicant Bank a total sum of Rs.32,91,6721- (Rupees Thirty Two Lakhs Ninety One Thousand Six Hundred and Seventy Two only) i.e.,

The Applicant Bank is also entitled to proceed against the person and properties of defendant No.1 towards realization of the debt due.

The Applicant Bank is entifled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

Issue Recovery certificate accordingly.

Communicate a copy of the order to the parties concerned.
