1. The learned counsel for the applicant submits that defendant Nos.

1 to 4 and 6 have been served through RPAD on 21/10/2025 and
24/10/2025. The defendant No.5 is deceased, and her husband,
who is already in the array as defendant No.2 has been duly
served through RPAD on 21/10/2025. Service affidavit is filed
on record at Exhibit-11. Despite service, the defendants neither
appeared nor filed WS. Statutory period for filing WS has
already been over. Hence, Counsel for applicant requested to
pass ex-parte order against defendants.
2. Heard.
3. None appeared for the defendants, though served. In these
circumstances, it appears that, the defendant Nos.1 to 4 and 6 are
not interested in filing the Written Statement or has nothing to
show cause; hence, they are hereby proceeded ex-parte .
4. Counsel for applicant is hereby directed to implead LR’ s of
deceased defendant No.5 before next date of hearing.
