The Applicant Bank fired the present oA against Defendant for recovery of a total sum of Rs.22,67,632.00 ps. (Rupees Twenty Two Lakhs Sixty Seven Thousand Six Hundred and Thirty Two Onty) with future interest @ 1Z.OS% p.a with monthly rests from 04.11.2025 till the date of realization.

As per the averments in the application, the Applicant Bank states that Defendant availed personal loan facility under Xpress Credit Elite scheme of Rs.25.00 Lakhs repayabte in 72 equated monthly installments of Rs.4g,941/- p.m with interest @ 11.55o/o p.a with monthly rests and executed personal Loan Agreement dated 27.07.2023 in favor of the Applicant Bank. t/1,'-r After availjng the loan facitity, the defendant failed to compty the /* terms of+qQnction, hence the applicant bank classified the i,. * 09 ,.accopnt ar |tPA on25.06.2025 and issued Legalnotice dated ) "=^ll I I li, t-t^'.,':-, 2 .,i",- .t' .. :i^:.a/. ;:.)-'

30.08.2025 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this oA.

Defendant called absent and set exparte on 06.01.2026.

Sri. Aravind Abdeshi, Assistant Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.7.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Appricant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant called absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, officlal of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.7. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and heince the Applicant Bank is entifled to recover the claim made i r OA with f.rJture interest and costs. ,t;

ln the result, the present OA is allowed with costs, as under :

The Defendant is riabre to pay to the Appricant Bank a totar sum of Rs.22,67,632.00 ps. (Rupees Twenty Two Lakhs Sixty Seven Thousand Six Hundred and Thirty Two Only) with future interesr @ 12.0s% p.a from 04.11.202s tiil the date of realization.

The Applicant Bank is entifled to proceed against the person and properties of defendant towards realization of the debt due.

That Applicant Bank is entifled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

lssue Recovery Certificate accordingly.

Communicate a copy of the order to the parties concerned.
