The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.25,42,904.50 Ps. (Rupees Twenty Five Lakhs Fofi Two Thousand Nine Hundred Four and Paise Fifty Only) with future interest @ 24.00% p.a with monthly rests from 26.05.2023 till the date of realization and in default for sale of Mortgaged Properties as mentioned in the Schedules of Property I and ll to OA.

As per the averments in the application, the Applicant Bank states that Defendant No. 1 is a Applicant and Defendant No. 2 is a Co-applicant availed Kisan Credit card for Agri Term Loan of Rs.19,20,000/- with interest @12.85o/o p.a with monthly rests and executed.l.Iypothecation Deed dated 01 .10.2020 in favor of the Applicant Bdnk. morefully mentioned in Schedules I and ll to the OA and executed Deposit of rifle deeds dated 20.02.2020 in favor of the Applicant Bank and Defendant no. 1 deposited Original title deeds in favor of the Applicant Bank . After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued Loan Recall notice dated 2g.11.2024 to lhe defendants. lnspite of several reguests and demands, the defendants did not clear the outstanding. Hence this OA.

Sri. K. Rajayaswanth, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.12.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendants as prayed for?

established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendants No. 1 and 2 are joinily and severally liable to pay to the Applicant Bank a total sum of of Rs.25,42,904.50 ps. (Rupees Twenty Five Lakhs Fofi Two Thousand Nine Hundred Four and Paise Fifty Only) with future interest @12.85%^{p.a from 26.05.2023 tilt the} date of realization.

The Applicant Bank is entitled to proceed against the Mortgaged Properties as mentioned in the Schedules of Property I and ll to the OA towards realization of the debt due.

The Applicant Bank is also entitled to proceed against the person and properties of defendants No. 1 and 2 towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.
