The Applicant Bank filed the present OA for the recovery a total sum of Rs.36,80,227l- with future interest @24olo p.a. from 28.07.2025 till the date of realization along with costs and, in default, sale of OA hypothecated asset.

Summon served on Defendant Nos. 1 to 3 and were set exparte on 11.03.2026 as called absent and no representation.

The Applicant Bank examined Mr. N. Chandrasekhar, Regional Relationship Manager, as AW-1 and marked g documents through him as Ex.A.1 to Ex.A.8.

Learned counsel for the applicant reported order may be passed on record. Perused the material placed on record.

The point that arises for consideration is: -

Whether the Applicant Bank is entitted for the claim made in the OA against the Defendants and 04 hypothecated AssetZ

As stated supra, the Defendants remained ex_parte. The Evidence Affidavit coupred with the recitars in the documents viz., Exs.A,l to A.g marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are liable to pay the OA claim to the Appticant Bank with future interest ana ortTfiffig

In the result, the^present Original Application No.49l2026^is allowed as under:^-

i) The Defendant Nos. 1 to 3^jointly and severally are liable to^pay to the^Applicant Bank a sum Rs.36,80,2271- with^future interest @12.50o/o simple from the date^of application till the date of realization;

ii) the OA claim is secured bY^{way of} hypothecation of asset as described^{in the} schedule annexed to the OA and^the applicant bank is^{entitledto proceed against} the same to^{realise its debu}
