The Applicant Bank filed the^present OA for the^{recoverya total} sum of Rs.29,49,834.95ps i.€., Rs.29,21,269.95ps^under housing finance loan A/c.No.160001298860 with future^interest @8.20olo^{p.a. and Rs.28,565/- under Canara Home SecureLoan} A/c.No.164002956256 with future interest @8.50o/o^p.a.from the defendant from the date of filling the application till^the date of realization along with costs, and in default,^{sale of OA} schedule^property.

Summon served on Sole Defendant through^{paperpublication} and was set ex-parte on 12.03.2026 as called absent and^no representation.

The Applicant Bank examined Mr. Naveen Kumar D, Manag€jr, as AW-1 and marked 32 documents through him as Ex.A.1^to Ex.A.32.

Heard the Ld. Counsel for the Applicant Bank. Perused the material placed on record.

The point that arises for consideration is: -

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendant and OA mortgage property?

As stated supra, the Defendant remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs.A.1 to A.32 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendant.

Hence, I hold that the Defendant is liable to^pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.104712025 is allowed as under: -

i) The Defendant is liable to pay to the Applicant Bank a total sum of Rs.29,49,834.95ps i.e., Rs.29,21,269.95ps under housing finance loan A/c. No. 160001298860 and Rs.28,565/- under Canara Home Secure Loan A/c. No. 764002956256; with future interest @8.6070 p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of property described in the schedule annexed to the OA and the applicant bank^ls entitled to proceed against the same to realise its debu

iii) the applicant bank is also entitled to^proceed against the person and^propertiesof defendants for realization of its dues;

iv) the applicant bank is entitled for the costs.

B. The Applicant Bank is directed to file Cost Memo^{within2 weeks} from the date of receipt of this Order.
