The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.21,54,440.00 Ps. (Rupees Twenty One Lakhs Fifty Four Thousand Four Hundred and Forty Only) with interest @11.55% p.a with monthly rests plus @2o/o^{penal interest from 29.08.2025till the date of realization.}

As per the averments in the application, the Applicant Bank states that Defendant availed Personal Loan under Xpress Credit Elite Limit of Rs.23,53,0001 repayable in 72 equated monthly installments with interest @11.55% p.a with monthly rests and executed Personal Loan Agreement dated 01.12.2023 in favor of the Applicant Bank. After availing the loan defendant failed to comply the terms of sanction, $ applicant bank classified the account as NPA on issued Legal Notice dated 09.08.2025 to the * 2 12 rrB r[0

defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 09.02.2026.

Sri. M Ravinder, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to 4.6.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1 , official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.6. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under:

The Applicant Bank is entifled to proceed against the person
