As stated supra,^{the Defendants remalned absent and did not turn up to controvertthe} version of the O.A. of Applicant^{Bank. The EvidenceAffidavitcoupled wlth the recitals in the} documents viz,, Exhibit^{Annexure-A,/1to ExhibitAnnexure-A'/26markedon behalfof the} Appllcant Bank, established^{the clalm of the Applicant Bank agalnst the Defendants andoA} schedule^{properties. Hence, I hold that the Defendants are lolntlyand severally liable to pay} to the Applicant^{Bankthe clalms made in the OA with futureinterest and costs'}

In the result, the^{present Orlglnal Applicationis allowed ex-parte withcosts, as under:-}

(1) O.A. No. 383 of 2025 filed by the^{AppllcantBank is allowed and debt is determinedwith cost} against the defendants.^{lt ls hereby orderedthat applicant bank ls entitledto recoverfrom} the defendants the^{total amount to the tune of Rs. 22,33,25037l-(Rupeestwenty two lakh} thlrty three thousand^{two hundred flfty andpaisa thirtysevenonly) with pendenteliteand} future interest @^{13oloper annum Interestwith simple on the amountdue from the dateof} filing of the Orlginal Appllcatlon^{l.e'f5lO5/2O25 till full and flnal reallzationof the claim} amount.

(2) Amount, if any, paid by the defendants^{ln the loan accounts or amount,lf any, recoveredby} the Appllcant Bank after^{flllng of the O,A. the same be taken lntoaccountwhile arriving at} the exact amount of dues/debt^{payable by the defendantsAccordingly, pendentelite and} future lnterest shall be calculated^{on the rcduced amount.}

(3) Defendants are debarred from dlsposlng,^{alienatingor deallngwlth any of theproperties} belonging to them till the^{aforesald decretal debt is recovered from the defendants'}

(4) Defendants are given a time of thlrty days^{from the date of the Judgement/Final order for} repayingoftheabovementloneddues,sointimatedtothem.Incasethedefendantsfailto paythedueswithintheabovementlonedtime,theappllcantbankisentitledtorecoverits

(5) Let the Certificate of Recovery be^{drawn up by Ld. Registrar forthwith in termsof} Judgement for issuance^{of thesame against defendantsin favour of theapplicantbank} under Section 19⁽²²⁾ of^{the Recoveryof Debtsand BankruptcyAct, 1993 and put up the} same for issuance of the Certificate.

(6) Ld. Recovery officer shall realize the amount^{as per the Recovery Certificatefromthe} defendants ln accotdance^{with law.}

Registrar of thls Tribunal is dlrected^{to dellver recovery certificate in term of theflnal} order/judgement for recovery^{of the sum against the defendantin favourof the Applicant} Bank under Section 19^{(22) of the Recovery of Debtsdue to the Bank and Financial} Institutions Act, 1993 now known^{as Recoveryof Debtsand BankruptcyAct, 1993'}
