ORDER

The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.41,89,894.781- | Rupees Fofi One Lakhs Eighty Nine Thousand Eight Hundred and Ninety Four and Paise Seventy Eight Only) with future rate of interest @24.00% p.a with monthly rests from the date of this application till the date of realization.

As per the averments in the application, the Applicant Bank statesthat Defendant availed Personal loan of Rs.40,45,4151

repayable in 72 equated monthly installments of Rs.75,456/p.m with interest @10.25%o p.a and executed Loan Agreement dated 20.05.2022 in favor of the Applicant Bank. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued Demand Notice dated 23.04.2026 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1 , official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.9. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the^{Defendant and} hence the Applicant Bank is entitled to recover the claim^madein the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under^:

The Defendant is liable to^pay to the Applicant Bank a total^sum of Rs.41,89,894.781- ( Rupees Forty One Lakhs Eighty^Nine Thousand Eight Hundred and Ninety Four and^Paise Seventy Eight Only) with future rate of interest @24.00o/o^p.a from the date of this application till the date of^realization.
